These Terms of Service ("Terms") constitute a legally binding agreement between you and Geoffrey Doyen ("Beastr," "we," "us," or "our") governing your use of the Beastr mobile application and related services (collectively, the "Service").

IMPORTANT: PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER (SECTION 15) THAT AFFECT YOUR LEGAL RIGHTS.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

You must be at least 16 years of age to use the Service.

2. Description of Service

Beastr is an AI-powered motivational audio application that generates personalized speeches based on your preferences and input.

2.1 Important Disclaimers

THE SERVICE IS FOR ENTERTAINMENT AND GENERAL MOTIVATION ONLY. All content is generated automatically by artificial intelligence without human review or oversight.

The Service:

• Is NOT a substitute for professional medical, psychological, psychiatric, or mental health care
• Does NOT provide medical diagnosis, treatment, or clinical advice
• Does NOT provide financial, legal, investment, or professional advice
• Should NOT replace consultation with qualified healthcare providers or professionals
• Does NOT guarantee any specific outcomes or results

We are not responsible for the accuracy, appropriateness, or suitability of AI-generated content.

4. Content Advisory

Beastr generates motivational content that may include:

• Strong, direct, or intense language designed for high-performance mindsets
• Mature themes intended for adult audiences
• Optional explicit/profane language (controllable in your profile settings)

You can adjust content intensity and language preferences in your profile settings at any time.

5. Account Registration & Security

5.1 Account Creation

You must provide accurate, current, and complete information when creating an account. You may not use false identities or impersonate any person.

5.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately at support@beastr.app of any unauthorized access

5.3 Account Restrictions

• Accounts are personal and non-transferable
• One account per person
• You may not share account access with others

6. Subscriptions, Billing & Cancellation

6.1 Subscription Tiers

We offer subscription tiers (Recruit, Warrior, King) with varying features and AI generation credits. Current pricing and features are displayed in the App.

6.2 Free Trial

New Recruit subscribers may receive a 7-day free trial. Your subscription will automatically convert to a paid subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends.

6.3 Billing & Auto-Renewal

• Subscriptions are billed through Apple App Store or Google Play Store
• Subscriptions automatically renew at the end of each billing period at the then-current price
• You authorize recurring charges to your payment method

6.4 Cancellation

You may cancel your subscription at any time through your device's subscription settings. Upon cancellation:

• You retain access until the end of your current billing period
• No refunds for partial periods
• AI generation credits do not carry over or receive refunds

6.5 Refund Policy

• During Trial: Cancel anytime within the trial period at no charge
• After Trial: All subscription payments are non-refundable
• Refund requests are subject to Apple's or Google's respective policies

7. User Content & Licenses

7.1 Your Input

You retain ownership of the topics, text, and voice recordings you submit ("User Input"). By submitting User Input, you grant us a limited, non-exclusive, royalty-free license to process this content solely for generating your personalized speeches.

We do not use your User Input to train AI models.

7.2 Generated Content

AI-generated speeches ("Generated Content") are provided for your personal, non-commercial use only. You may:

• Listen to Generated Content within the App
• Share Generated Content through the App's built-in sharing features

You may not:

• Download, extract, or copy Generated Content outside the App
• Redistribute, sell, license, or commercially exploit Generated Content
• Use Generated Content in other applications, products, or services

8. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose
• Attempt to reverse-engineer, decompile, or extract source code, algorithms, or AI models
• Circumvent subscription limitations, access controls, or security measures
• Submit content that is illegal, defamatory, harassing, threatening, or infringes third-party rights
• Use automated tools, bots, scrapers, or scripts to access the Service
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Use the Service to generate content promoting violence, hatred, or illegal activities
• Create multiple accounts to circumvent restrictions or abuse free trials

Violation may result in immediate termination without refund.

9. Intellectual Property

The Service, including all software, designs, text, graphics, audio, interfaces, and underlying technology, is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. "Beastr" and associated logos are our trademarks.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

10. Third-Party Services

The Service integrates with third-party providers for authentication, payment processing, AI content generation, and analytics. Your use of third-party services is subject to their respective terms and privacy policies.

11. Service Availability & Modifications

We strive to maintain Service availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, including loss of profits, revenue, data, or goodwill.

OUR TOTAL AGGREGATE LIABILITY shall not exceed the total amounts you actually paid to us for the Service in the 12 months immediately preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Beastr and its officers, employees, agents, and licensors from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Dispute Resolution & Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

15.1 Informal Resolution First

Before initiating formal dispute resolution, you agree to contact us at support@beastr.app and attempt to resolve the dispute informally for at least 30 days.

15.2 Binding Arbitration Agreement

If we cannot resolve a dispute informally, you and Beastr agree that any dispute shall be resolved exclusively through final and binding arbitration, rather than in court.

15.3 Class Action & Jury Trial Waiver

YOU AND BEASTR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR CONSOLIDATED ACTION.

YOU WAIVE ANY RIGHT TO A JURY TRIAL.

15.4 Opt-Out Right

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to: legal@beastr.app with "Arbitration Opt-Out" in the subject line.

16. Termination

16.1 Termination by You

You may terminate your account at any time by deleting your account through the App settings or contacting support@beastr.app.

16.2 Termination by Us

We may suspend or terminate your account and access to the Service at any time, with or without cause, including for violation of these Terms, fraudulent or illegal activity, or non-payment.

16.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• Your account and Generated Content may be deleted
• No refunds for unused subscription periods or AI credits

17. General Provisions

17.1 Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.

17.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Beastr regarding the Service.

17.3 Changes to Terms

We may modify these Terms at any time. Material changes will be notified at least 30 days in advance via email or in-app notification.
